BOT TERMS OF SERVICE

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:

• Company (referred to as either 'the Company', 'We', 'Us', or 'Our' in this Agreement) refers to RAC Corp.
• Service (also referred to as 'Bot' or 'Application') refers to the RAC Bot and its associated features, commands, and functionality provided within Discord.
• Terms and Conditions (also referred as 'Terms') mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• You means the individual Discord user accessing the Service, or the Guild owner/administrator authorizing the Bot's use within a Guild.
• Discord refers to the communications platform operated by Discord Inc. where the Bot is made available.
• Guild (also referred to as a 'Server') means any specific community or collective space on Discord where the Bot has been 'invited', or authorized to operate in.
• Third-party Services means any services, APIs, or content (including data, information, or products) provided by a third-party (including Discord Inc.) that may be utilized or made available by the Bot.

We reserve the right to manage the availability of the Service to maintain the health of the Bot and the safety of the Discord community.

• We may terminate or suspend Your access to the Bot immediately, without prior notice or liability, for any reason, including if You breach these Terms and Conditions.
• We reserve the right to remotely remove the Bot from any Guild that is found to be in violation of Discord's Community Guidelines or is using the Bot to facilitate harmful activities.
• Upon termination, Your right to use the Service will cease immediately.

By adding the Bot to a Guild, installing it to Your Discord account, running any of its commands, or using the Company's website or API, You agree to these Terms and Conditions, the Company's Privacy Policy, and Discord's Terms of Service and Community Guidelines. If You do not agree, do not access or use the Service.

• You must be at least 18 years old to access or use the Service. By doing so, You represent and warrant that You are at least 18 years old.
• Commands identified as NSFW may only be used in Discord channels designated as age-restricted by Discord.
• You agree not to use the Service to create, upload, request, or distribute child sexual abuse material (CSAM), whether real or AI-generated.
• You agree not to create or share sexual or intimate imagery of a real person without that person's consent and knowledge, or sexualized deepfakes of any person.
• You agree not to harass, threaten, dox, or intimidate anyone, or promote violence, extremism, self-harm, or illegal activities.
• You agree not to post NSFW content using the Bot outside Discord channels designated as age-restricted.
• You agree not to infringe anyone's copyrights or trademarks.
• You agree not to scrape, mine, or bulk-collect data through the Service, or use it to collect information about Discord users.
• You agree not to spam, automate or abuse commands, bypass rate limits or any blocks or restrictions imposed by the Bot, or interfere with the Bot's security or operations.
• You agree not to use the Service in violation of Discord's Terms of Service or Community Guidelines.
• If You are a Guild administrator, You are responsible for ensuring that the Bot's configuration within Your Guild does not violate these Terms or the rights of Your members.

THE SERVICE IS PROVIDED TO YOU 'AS IS' AND 'AS AVAILABLE' AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND.

To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including:

• All implied warranties of merchantability and fitness for a particular purpose.
• Warranties that the Bot will meet Your requirements or achieve any intended results.
• Warranties that the Bot will be compatible with other software, applications, or Discord API updates.
• Warranties that the Service will operate without interruption or that any errors or bugs will be corrected.
• Any warranties arising out of course of dealing, course of performance, or usage of trade.

Without limiting the foregoing, neither the Company nor any of the company's providers makes any representation or warranty of any kind, express or implied, as to the operation or availability of the Service, or the information, content, and materials included therein.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever. This includes, but is not limited to:

• The loss or corruption of Guild settings, user data, or message logs resulting from Bot failure or command execution.
• The Company is not liable for damages resulting from Discord API outages, server downtime, or the inability to access the Bot.
• We are not responsible for any damages arising from unauthorized access to Your Discord account or Guild, or any actions taken by the Bot due to compromised administrative credentials.
• The Company is not liable for the conduct of any third party, including Discord Inc. or other users within a Guild.
• The Company shall not be liable for any loss of profits or business interruption resulting from the use or inability to use the Service.

In no event shall the total liability of the Company under any provision of these Terms exceed the amount actually paid by You through the Service, or 50.00 USD if You haven't purchased anything through the Service.

You agree to use the Service's AI features legally and in accordance with the acceptable-use restrictions in Section 3. These restrictions apply whether content is created, uploaded, requested, or distributed, and whether it is generated by AI or otherwise.

• You are strictly prohibited from using the Bot to generate or facilitate illegal, violent, or otherwise harmful content.
• You assume responsibility for content You submit to or generate using the Bot's AI features, subject to applicable law and these Terms.

To ensure the stability and availability of the Service for all users, You agree to the following restrictions regarding Bot interaction:

• You shall not intentionally flood the Bot with rapid, repetitive commands or automated scripts designed to disrupt the Service.
• The Bot employs internal rate-limiting measures. You agree not to attempt to bypass or circumvent these limits using multiple accounts or alternate Guilds.
• You are prohibited from using the Bot to distribute unsolicited advertisements, 'spam' messages to other users, or mass-mentioning users within a Guild.
• You are prohibited from using automated scripts or 'self-bots' to interact with the Bot in a manner that creates an unfair load on Our infrastructure.
• If You discover a bug or exploit that allows for command spamming or resource exhaustion, You agree to report it to the Company rather than exploiting it.
